Article 1 – Seller
These terms of sale apply to all orders placed on the Shoptracteur website, operated by SCI LES TRACTEURS, a société civile with share capital of €400,000, registered with the Strasbourg Trade and Companies Register under number 908 544 810, registered office at 4 rue Martin Bucer, 67000 Strasbourg, operating address 2 Quai Sud, 50400 Granville, France, VAT FR14908544810, email shoptracteur@gmail.com (hereinafter "the Seller").
Article 2 – Scope
These terms govern distance sales of tractors, agricultural equipment, implements and parts (hereinafter "the Products") between the Seller and any buyer, whether a consumer or a business (hereinafter "the Customer"). Placing an order implies unreserved acceptance of these terms, which are available on the website at all times. Provisions specific to consumers (right of withdrawal, legal guarantee of conformity, mediation) apply only to Customers acting for non-business purposes.
Article 3 – Products
The essential characteristics of the Products are presented on each product page. Photographs are as accurate as possible but are not contractually binding. Used equipment is sold in the condition described on its product page (year, hours of use, general condition). Offers are valid while stocks last.
Article 4 – Prices
Prices are shown in euros, including all applicable taxes, excluding delivery costs, which are shown before the order is confirmed. The Seller reserves the right to change its prices at any time; the applicable price is the one displayed at the time of the order.
Article 5 – Orders
The Customer selects the Products, checks the contents of the cart, enters their details, chooses the delivery and payment methods, then confirms the order. A confirmation email summarizing the order is sent to the Customer. The Seller reserves the right to cancel any order in the event of an existing dispute with the Customer, non-payment or manifestly incorrect information.
Article 6 – Payment
Payment is made using the payment methods offered at checkout. The order is processed only once the price has actually been received. The Products remain the property of the Seller until the price has been paid in full.
Article 7 – Delivery
Delivery terms, areas, times and costs are detailed in our Shipping Policy and are shown again before the order is confirmed. Risk passes to the consumer Customer when the Products are handed over. The Customer must check the condition of the Product on delivery and write down any specific reservations on the transport document, then confirm them to the carrier by registered letter within 3 days (article L.133-3 of the French Commercial Code), with a copy to the Seller.
Article 8 – Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the consumer Customer has 14 days from receipt of the Product to exercise their right of withdrawal, without having to give a reason. The Customer notifies their decision by an unambiguous statement sent to shoptracteur@gmail.com or to 2 Quai Sud, 50400 Granville, France, possibly using the form below. The Product must be returned within 14 days of this notification. Return costs are borne by the Customer; due to their nature, some bulky Products cannot be returned by post and their return cost is estimated on request. The Seller refunds all amounts paid, including standard delivery costs, within 14 days of the notification; this refund may be withheld until the Product has been recovered or proof of shipment has been provided. The Customer may be held liable for any loss in value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning.

Article 9 – Legal guarantees
All Products benefit from the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). The consumer Customer has two years from delivery of the goods to act under the guarantee of conformity; for used goods, this period is reduced to one year. The Customer may choose between repair and replacement of the goods, subject to the conditions of article L.217-12, and does not have to prove the existence of the defect during this period. In the event of a hidden defect, the Customer may choose between cancellation of the sale and a price reduction (article 1644 of the French Civil Code). Article 10 – Liability
The Seller cannot be held liable for failure to perform the contract due to force majeure, the act of a third party or the act of the Customer, in particular in the event of improper use of the equipment or failure to follow the manufacturer's safety instructions.
Article 11 – Personal data
Data collected is processed in accordance with our Privacy Policy.
Article 12 – Complaints and mediation
Any complaint should first be sent to shoptracteur@gmail.com. If a written complaint is unsuccessful, the consumer Customer may use a consumer mediator free of charge, in accordance with articles L.612-1 et seq. of the French Consumer Code.
Article 13 – Governing law
These terms of sale are governed by French law. Failing an amicable settlement, disputes will be brought before the competent courts; for business Customers, jurisdiction is given to the courts of the Seller's registered office.
